No formal request yet for Quiboloy extradition to US, says DFA

MANILA — The Department of Foreign Affairs (DFA) told senators Wednesday that it has yet to receive a formal request from the United States for Kingdom of Jesus Christ leader Apollo Quiboloy to be extradited there over sex trafficking and other charges.

Quiboloy, who was subject to a massive manhunt in Davao City in August, had claimed a conspiracy between the Marcos Jr. and the US to kidnap him and bring him to the United States. He said that he would surrender to authorities if they could guarantee that he would not be sent to the US, a condition that government said he was in no position to make.  

"We wish to report that [we have] not received a formal extradition request," DFA Secretary Enrique Manalo told the Senate Committee on Women, which is currently investigating the alleged abuses of the disgraced pastor.

Quiboloy was arrested on September 8, with his supporters making the distinction that he had surrendered to the military and not to the Philippine National Police that had been searching the KOJC compound in Davao City for weeks.

EXTRADITION TREATY WITH THE US

The Philippines and United States signed an extradition treaty in 1994. 

The DFA also said that its foreign service posts have not yet received any request for assistance from possible trafficking victims of Quiboloy.

"As of this date none of our foreign service posts have reported receiving request for assistance... But we are standing by," Enrique said.

Enrique explained that in the event that that they receive a formal extradition request, it would still be studied before they refer it to the Department of Justice for "relevant action."

"We will study it and see if it is consistent with the agreed procedure pertaining to extradition... And then after we're satisfied with the request, we will of course refer it to DOJ," he said.

On November 10, 2021, a US federal warrant was issued against Quiboloy after he was indicted for conspiracy to engage in sex trafficking by force, fraud and coercion and sex trafficking of children among other charges.

Quiboloy also faces similar charges in the Philippines and is currently detained. He has repeatedly denied the allegations. 

According to 1994 treaty, requests for extradition should be sent through diplomatic channels and should be supported by documents like statements of and details of the alleged offense, a copy of the judicial warrant and the charging document.

The requesting country must also send "such evidence as, according to the law of the Requested State, would provide probable cause for his arrest and committal for trial if the offense had been committed there."

A requested state may reject the request if it determines that it is politically motivated, or is for a "military offense which is not punishable under non-military penal legislation."

Extradition will also be rejected if the person subject to the request has been tried and convicted or acquitted “in the Requested State for the offense for which extradition is requested.”
