MAYNILA — Hindi lang mga senador kundi maging mga eksperto sa batas at konstitusyon ang sumagot sa mga banat nina House Speaker Alan Peter Cayetano at iba pang mambabatas na "unconstitutional" ang gagawing Senate hearing ukol sa franchise ng ABS-CBN.

Lunes itinakda ang pagdinig ng Senate Committee on Public Services tungkol sa prangkisa ng ABS-CBN, pero para kay Cayetano, katakataka umano ito.

Puna niya: "Nagtataka lang ako kay Sen. Grace Poe (committee chair) at sa mga senador... Ano ba sabi sa Constitution? Saan ba mag-uumpisa ang prangkisa? Sa House o sa Senate?"

Iniskedyul ni Poe ang hearing upang matalakay na ang isyu sa franchise ng ABS-CBN. Pero sabi ni Cayetano, dapat igalang ng Senado ang poder ng Kamara.

"Dapat may inter-chamber courtesy," ani Speaker.

KINONTRA

Pero kinontra ito ng ilang senador at abogado kabilang si dating Chief Justice Maria Lourdes Sereno.

"When you talk about inter-parliamentary courtesy, that means that it’s not a strict rule di ba? It just talks about the relationship of the House and the Senate," ani Sereno.

Ayon naman kay dating UP College of Law dean Pacifico Agabin, walang sinasabi sa Konstitusyon na bawal mauna ang Senado sa pagdinig sa mga local bill gaya ng ABS-CBN franchise.

"It does not preclude the Senate from hearing preliminarily an application, if only to expedite the process. Since the Senate is an independent body, it can also conduct its own hearing," ani Agabin.

Iginiit din ng maraming senador na walang nagbabawal sa Senado na dinggin ang mga usaping mahalaga sa interes ng publiko.

"There is nothing that prevents the Senate from conducting a public hearing on issues concerning public interest," sabi ni Sen. Joel Villenueva.

"We conduct committee hearings on tax and budget measures even before the [House] has transmitted their approved version of bill to the Senate," ani Sen. Panfilo Lacson.

"The hearing is focused on the resolutions filed re [ABS-CBN] not whether we should approve its franchise or not," sabi naman ni Senate President Tito Sotto.

Higit 11 panukala para sa renewal ng ABS-CBN franchise ang nakatengga ngayon sa Kamara.

Sinabi naman ni Presidential Spokesperson Salvador Panelo na hindi dapat seryosohin ng mga mambabatas ang mga birada ni Pangulong Rodrigo Duterte sa ABS-CBN.

"If you are influenced by the actions of this man (Duterte) or the utterances of this man, then you have no business being members of Congress. Why does the Speaker have to take a cue from Malacañang? Why do members of Congress have to wait for what the President will say about anything?" ani Panelo.

Ayon sa agenda ng Kamara sa Lunes, maghi-hearing ang House Committee on Legislative Franchises kasabay ng pagdinig ng Senado sa ABS-CBN franchise.

Tatlong prangkisa ang tatalakayin ng komite pero hindi kasama ang sa ABS-CBN.
