Mainit ang naging palitan ng salita sa pagitan nina Supreme Court (SC) Chief Justice on leave Maria Lourdes Sereno at Associate Justice Teresita de Castro sa oral arguments na idinaos nitong Martes sa Baguio City.

Dinidinig ng SC ang quo warranto petition ng Office of the Solicitor General (OSG) para mapawalang-bisa ang pagkakatalaga kay Sereno bilang punong mahistrado.

Si De Castro ang buena manong nagtanong kay Sereno, na kilalang naging katunggali nitong huli at naiulat ding madalas na nakakaalitan sa loob ng Korte Suprema.

Maraming beses nagtaasan ng boses ang dalawang mahistrado, at mitsa nito ang unang tanong pa lang ni De Castro tungkol sa Statement of Assets, Liabilities, and Net worth (SALN) ni Sereno.

"I would like to ask you about the submission of your SALN. Did you religiously comply with the submission of the SALN as mandated by law?" tanong ni De Castro.

Hindi agad ito sinagot ni Sereno, at bagkus ay tila ibinalik niya ang tanong sa mga mahistrado na kung handa ba silang sumailalim rin sa quo warranto sakaling ungkatin ang kanilang SALN.

"Before I answer that question, can I have your assurance that should a quo warranto petition be filed against any of you, on the ground that one or more of your SALNs are not on record, that you would also, under oath, declare before this court, answer all questions regarding your SALNs," paghahamon ni Sereno.

Ibinunyag din niyang maging si De Castro, hindi umano kumpleto ang isinumiteng SALN.

"For example Justice De Castro who should have filed 39 SALNs but filed only 15 with the JBC (Judicial and Bar Council)," ani Sereno.

"Will you please answer the question? You are being asked a question. You are under oath," sagot naman ni De Castro.

Pinupuna ni De Castro ang diumano'y pagkabigo ni Sereno na magsumite ng SALN habang ito ay propesor sa University of the Philippines (UP) College of Law kung saan ito 20 taon nagturo bago magbitiw noong 2006.

Sagot ni Sereno, walang tumawag ng kaniyang pansin, lalo na si noo'y Chief Justice Renato Corona.

"It was the duty of Chief Justice Corona, as head of the institution, to tell me if there were problems with my SALNs, but he did not. The JBC did not," aniya.

At dahil pitong beses aniya silang nagpalipat-lipat ng tirahan, hindi na rin umano naitago ni Sereno ang mga dokumento.

Lagpas dalawang oras nagtagal ang tensiyonadong interpellation sa pagitan nina Sereno at De Castro.

Ang pagsusumite ng SALN ay isa sa mga requirement ng JBC upang tukuyin kung kalipikado nga ang isang kandidato sa isang posisyon sa hudikatura.

Sa quo warranto petition ng OSG, sinabi nitong ang hindi kumpletong SALN ni Sereno ay isang patunay na wala itong integridad upang mamuno bilang punong mahistrado.
