Nirerespeto at hindi umano nagpapaimpluwensya ang pinuno ng Securities and Exchange Commission (SEC) na si Teresita Herbosa kaya't imposibleng may malisya ang desisyon ng ahensya kontra sa news site na Rappler.

Ito ang iginiit ni Presidential Spokesperson Harry Roque nang tanungin kung may kinalaman ang pagkansela ng lisensya ng Rappler sa mga kritikal na istorya nila sa administrasyon.

"That's really something lawyers will find difficult to accept, that chair Herbosa is a person who can be influenced in making a decision that is contrary to the law. Chair Herbosa is simply not capable of that," ani Roque.

Dagdag ni Roque, "nirerespeto" umano si Herbosa sa larangan ng abogasya.

"If you respect Maria Ressa in the journalism profession, Herbosa enjoys the same respect amongst lawyers...It is unfair to her to think that she was acting merely as a lackey of the President," giit ni Roque.

Nauna nang ipinaliwanag ng SEC na nilabag ng Rappler ang Saligang Batas nang bigyan ng kontrol sa kanilang operasyon ang Philippine Depository Receipt (PDR) holder na Omidyar Network Fund, isang dayuhan na kompanya.

Paliwanag ng SEC, isa sa mga probisyong nakasaad sa PDR ng Omidyar ay ang pangangailangan ng kanilang pahintulot sa pagpapalit ng by-laws ng Rappler.

"That means that Rappler cannot even change the principal office address, the date of meetings--those are operational policies of the corporation, which means the PDR-holders exercise right of ownership," ani SEC spokesperson Armand Pan sa programang Market Edge ng ANC.

Nakasaad sa Saligang Batas na ang mass media entities ay dapat 100 porsiyentong pagmamay-ari at kinokontrol ng Pilipino o Pilipinong kompanya.
