Napoles asks for deferment of her transfer to Mandaluyong jail

MANILA - Businesswoman Janet Lim Napoles is asking the Sandiganbayan 1st Division to allow her to stay at the Bureau of Jail Management and Penology detention facility in Camp Bagong Diwa in Taguig City.

Napoles’ lawyer Erwin Legaspi filed a “very urgent motion for reconsideration” Friday after the anti-graft court handed its guilty verdict against Napoles in connection with the Priority Development Assistance Fund scam.

After the promulgation, the court ordered the imprisonment of Napoles at the Correctional Institution for Women in Mandaluyong City.

Legaspi however noted that the conviction of Napoles of plunder is not yet final.

“The judgment of conviction against herein accused has not yet attained finality. The judgment may still be modified as there are still remedies which the accused may exhaust and the period to do so has not yet lapsed,” Legaspi said in the urgent motion.

It was also stressed that Napoles’ stay at the CIW supposedly posed threats to her life and security.

Napoles was imprisoned at the CIW after she was convicted by a Makati court of serious illegal detention charge filed by PDAF scam whistleblower Benhur Luy which was later on reversed by the Court of Appeals.

“This plea is in light with the development of her entire cases which greatly affect her life and security. Her cases are considered high-profile due to involvment of high-ranking public officials,” Legaspi said.
