Imelda wants to elevate Sandiganbayan graft conviction to the Supreme Court

MANILA - Ilocos Norte Rep. Imelda Marcos has filed a notice of appeal before the Sandiganbayan as she wants to bring her conviction of 7 graft cases in connection with anomalous Swiss foundations to the Supreme Court.

In the notice of appeal her lawyer Manuel Lazaro filed before the Sandiganbayan 5th Division late Monday, Marcos has requested that her case records be submitted to the Supreme Court.

The anti-graft court is still deliberating on whether they will grant the motion of Marcos to be allowed to file post-conviction remedies such as a motion for reconsideration as well as bail to evade imprisonment as she was sentenced to 6 to 10 years of imprisonment for each case.

“Wherefore, accused Imelda Marcos hereby files this notice of appeal and requests that the records of the case be forwarded to the Supreme Court for further proceedings,” Lazaro said in the notice.

The camp of Marcos also took note that the court is still deliberating on their request for post-conviction remedies as they file their notice of appeal.

Effectively, Marcos is skipping the filing of a motion for reconsideration before the Sandiganbayan as her lawyers had earlier planned.

“To date, motion for leave filed by the accused has not yet been resolved. With due respect, the accused submits that the decision convicting her is contrary to facts, law and jurisprudence,” Lazaro said.

The notice of appeal comes after the recent ruling of the 5th Division in the case of a retired police officer convicted with finality that old age will not spare anyone from imprisonment.
