Marcos slams 'biased' SC justice, seeks inhibition in poll protest

MANILA - (UPDATE) Former Senator Ferdinand "Bongbong" Marcos on Monday sought the inhibition of the justice in-charge of his election protest against Vice President Leni Robredo.

Supreme Court Associate Justice Benjamin Caguioa "cannot deny that he is biased towards the ‘yellow brigade’ given his close ties with his friend and former boss, former Pres. Benigno ‘Noynoy’ Aquino III," Marcos told the high tribunal sitting as the Presidential Electoral Tribunal.

He said Caguioa's wife, Pier Angela, is an ardent Robredo supporter who actively campaigned for the vice president in the 2016 elections and "continued to work for her in this case."

"Maliwanag na maliwanag na at least at the household of Justice Caguioa, that they were working against me," he said.

Throughout the proceedings, Caguioa also exhibited a "pattern of bias."

"Sumusobra na at hindi na namin nakikita na makaktaanggap kami ng katarungan kung si Justice Caguioa pa rin ang in-charge sa kaso," he told reporters after filing the petition.

(It's too much and we no longer believe that we will be given justice if Justice Caguioa remains in charge of the case.)

The motion was not to question the tribunal's fairness, but "to preserve the justice we all expect from the Supreme Court," Marcos said in the press conference.

"I think it will be acted upon. I am very confident that the justices will continue and follow the proper procedure and response to this motion," he said.

"It was only Justice Caguioa who was acting against my interests and I’m fully confident that the other justices will take an objective view when they receive this motion that I have filed," he added.

Marcos filed a poll protest against Robredo after losing by about 260,000 votes.

In January, Marcos Jr. also said he wanted Caguioa out of the Presidential Electoral Tribunal because he has been unfair and unjust in the electoral protest.

Aquino appointed Caguioa, his former classmate at the Ateneo de Manila University, to the Supreme Court in January 2016.

Caguioa was Aquino's ad interim justice secretary in 2015 after Leila de Lima vacated the post to run for a Senate seat.

Before this, he was the president's chief legal counsel, where he was part of the country's delegation to argue before the Permanent Court of Arbitration for maritime claim over parts of the South China Sea.
