MANILA - Gabriela party-list filed a petition with the Supreme Court (SC) on Monday, urging the high court to order the Commission on Elections (Comelec) to grant its plea for a third seat in Congress.

"Comelec, instead of using 59.5 (number of seats available to party-list representatives), used 59 in the formula as an expression of the 20% Constitutional requirement, thereby arriving at 1.985515 instead of 2.0066375. This mathematical inaccuracy, as shown in the case of [Gabriela], results to a deprivation of additional seat that it is entitled to," the petition read.
