MANILA - The Bureau of Internal Revenue (BIR) guaranteed Sunday that it is going after the unsettled P2.9-billion documentary stamp tax (DST) of the Philippine Charity Sweepstakes Office (PCSO).

The unpaid DST covers 10% on the sales of Small Town Lottery (STL) tickets.

Speaking to radio dzMM, BIR Comissioner Kim Henares said they have not cleared PCSO of any liability in paying the DST, contrary to news reports.

The National Internal Revenue Code requires a 10-centavo DST for every P1 bet in online lottery, horse race, jai-alai and other authorized numbers games.

STL operators, however, have not been charged any DST since they started operating in 2006. They argued that they are only required to remit a portion of their sales to the PCSO, LGUs, and the national police headquarters and local stations.

Henares said that regardless of the agreement of PCSO and its STL operators, the responsibility of paying DST falls to the state-owned gaming corporation.

"Wala naman silang exemption sa documentary stamp tax. Ang primarily liable po diyan ay iyung PCSO. Kung papaano po sila at iyung mga STL operator nila nag-usap, sa kanila po iyun, hindi kami kasama," Henares said.

"Ang hinahabol namin ay kung sino ba ang nag-i-issue ng ticket. Ang nag-i-issue po ng ticket ay ang PCSO."

Henares said they are in the process of auditing the PCSO's income from STL and collecting its unsettled tax.

The BIR chief also warned PCSO officials of possible raps if it is proven that they deliberately opted not to pay the DST.

"Ang sabi -- hindi ko po alam kung totoo -- ng mga STL operators, ibinibigay naman daw iyung amount na DST sa PCSO; ang PCSO ang hindi nagbabayad. Kung ganoon ang sitwasyon, talagang makakasuhan ang mga officer ng PCSO," she said.
