Bulacan gov appeals SC decision on Angat Dam revenues

MANILA — Bulacan Governor Daniel Fernando filed a motion for reconsideration Thursday on the decision of the Supreme Court that the provincial government is not entitled to a share in revenues coming from the Angat Dam.

In a statement after the filing at the Supreme Court, Fernando said the Constitution as well as the Local Government Code of 1991 mandate the equitable share of local governments in the exploitation, development and utilization of natural resources. 

“Maliwanag po ang nakasaad: "LGUs shall have an equitable share in the proceeds derived from the utilization and development of the national wealth within their respective areas, including sharing the same with the inhabitants by way of direct benefits,” Fernando said in the statement. 

The governor also said it is his duty to ensure that the people of Bulacan receive what is due them.

“Dalangin natin na marapatin nawa ng ating Kataas-taasang hukuman na muling suriin ang kasong ito in consideration of the points presented in our Motion for Reconsideration,” Fernando said. 

(We pray that the Supreme Court will take a look at our case and consider the points we presented in our motion for reconsideration.)

In the decision of the high court promulgated last year, the province of Bulacan is not entitled to any share in the revenues coming from Angat Dam. 

“To be sure, when water is already taken or diverted from a natural source, it is considered appropriated water, as in the case of dam water or water already impounded in an artificial receptacle,” the court said in the decision penned by Associate Justice Henri Jean Paul Inting.
