Taguig court dismisses illegal detention raps vs Mayor Cayetano due to lack of evidence

MANILA — The Office of the City Prosecutor of Taguig has dismissed the charges of illegal detention and grave coercion filed against Mayor Lani Cayetano and other officials for lack of sufficient evidence.

In a 14-page resolution dated August 2, the Office of the City Prosecutor of Taguig dismissed the charges of illegal detention and grave coercion filed against Taguig City Mayor Lani Cayetano, City Administrator Jose Luis Montales, Business Permits and Licensing Office Head Maria Theresa Veloso, Traffic Management Office Head Danny Cañaveral, and other unnamed individuals. 

The dismissal was based on a lack of sufficient evidence to substantiate the allegations.

The complaints were lodged by Salvador C. Palisa, Ryalyn B. Almazar, Joven P. Mediavillo, and Salvador G. Mercado, all employees of the Makati City Government. They accused Taguig officials of unlawfully detaining them during incidents between March 1 and 3, 2024, related to the closure of the Makati Park and Garden and the Makati Aqua Sports Arena (MASA) due to the absence of necessary permits.

The complainants alleged that they were forcibly confined within the park by Taguig personnel, who either prevented them from leaving or blocked their entry. After reviewing the case, the prosecutor's office found that the evidence provided did not establish the existence of the crimes.

These events stem from an ongoing territorial dispute. In a landmark decision on December 1, 2021, the Supreme Court ruled that the Fort Bonifacio Military Reservation and 10 EMBO barangays, including Barangay West Rembo—home to the Makati Park and Garden and the Makati Aqua Sports Arena—rightfully belong to Taguig. This ruling became final on September 28, 2022.
