Roque insists PH no longer under ICC jurisdiction

Former Presidential spokesman Harry Roque insisted that the International Criminal Court (ICC) has no jurisdiction in the Philippines.

Roque reacted to reports that the ICC is seeking assistance to interview the alleged suspects in the "war against drugs" under the term of then President Rodrigo Duterte. 

"Wala pong katuturan 'yan dahil wala na pong hurisdiksyon ang ICC sa 'tin dahil tayo po'y bumitaw na sa pagiging myembro," said Roque in an interview on Teleradyo Serbisyo.

"Alam niyo po meron kasing rule na kapag ikaw ay bumitiw ang effectivity niyan ay one year from date of instrument deposit of instrument of withdrawal, dun sa one year na 'yun pwede pang magsimula ng kaso ang prosecutor pero ang nangyari naman dito sa prosecutor tulog sa pancitan -ag initiate siya ng preliminary investigation on the second year so dahil second year na yan wala na talagang hurisdiksyon ang hukuman."

Roque, who served under Duterte, also warned law enforcement units from serving warrants from the ICC.

"Aking sinasabi eh wala na pong hurisdiksyon yan at 'pag magkaroon ng warrant of arrest at kapag magkaroon ng warrant of arrest at pag sinilbi ng kapulisang Pilipino baka sila ma-demanda for unlawful detention dahil hukumang Pilipino na lang ang maaring mag issue ng warrant pang aresto," he claimed.

Earlier, the Department of Justice said it won't bar arrest warrants that the Interpol may issue against suspects in the ICC's probe on the drug war.

Justice Secretary Crispin Remulla explained that while the Philippines is no longer a member of the ICC, it remains a part of Interpol, which facilitates worldwide police cooperation and crime control.
