MANILA — The Commission on Elections’ (Comelec) decision on the recommended “misrepresentation” complaint against suspended Bamban, Tarlac Mayor Alice Guo will be out next week, chairman George Erwin Garcia said Friday.

The Comelec Law Department's report on Guo recommended the filing of a material misrepresentation complaint against the embattled official.

Garcia said the en banc would decide on how to proceed with the case by next week.

The preliminary investigation will commence once the en banc approves the report, to be followed by the filing of a complaint before the Tarlac Regional Trial Court if Guo fails to counter the charges, Garcia said.

The Comelec Law Department found that the fingerprints of Guo and of Chinese national Guo Hua Ping were the same.

According to the department, Guo allegedly violated section 74 of the Omnibus Election Code when she declared in her documents that she is a Filipino citizen.

Garcia insisted that they were not ganging up on Guo as claimed by her camp.

Meanwhile, Guo's lawyer Stephen David appealed to the public not to be swayed by what they see on social media regarding the suspended mayor.

“Sana huwag tayong ano, kasi masama yun eh. Be not a judge. Kasi masama yun, nagja-judge ka ng ibang tao,” he said.
