Enrile wants early production of evidence by prosecution in plunder case

MANILA - The camp of former Senator Juan Ponce Enrile has urged the Sandiganbayan 3rd Division to resolve his motion for the production of material evidence in the possession of the prosecution.

Enrile’s lawyer noted that the motion, which seeks the production of detailed evidence in his P172-million plunder case in connection with the pork barrel scam, was considered submitted for resolution by the court last March 13, 2019.

“Insofar as accused Enrile’s Motion for the Production of Material Evidence in the Possession of the Prosecution” is concerned, the same be resolved at the earliest opportunity, at all events, in time for accused to study and consider the materials before trial is held,” lawyer Estelito Mendoza said.

The prosecution had submitted its opposition to the motion, stressing that the request of Enrile is tantamount to premature presentation of evidence.

They also noted that they will adopt the judicial affidavit rule wherein documentary evidence will be furnished ahead of the testimony of their witnesses.

“In the meantime, there is no sufficient basis for the accused to burden the prosecution to heed to their desire for copies of prosecution's evidence when they were already afforded their full opportunity as early as the preliminary conference of this case,” the prosecution said.
