Comelec cancels candidacy of Dapitan mayoralty candidate over residency issue

DIPOLOG CITY - The Commission on Elections (Comelec) First Division cancelled the certificate of candidacy of Dapitan City mayoralty candidate, former Dipolog City Mayor Evelyn Uy.

In a resolution issued April 3, Comelec ordered the cancellation of Uy's candidacy in Dapitan City following a petition filed by incumbent Dapitan City Mayor Rosalina Jalosjos, questioning Uy's eligibility because she is not a resident of Dapitan City.

Uy’s lawyer, Atty. James Verduguez, said they are still waiting for the copy of the resolution but they are now preparing to file a motion for reconsideration.

“Definitely, once we receive the copy and confirm we will file the motion for reconsideration under the rules of the Commission on Elections we have five days from receipt within which to file the motion for reconsideration and filing the motion for reconsideration suspends the implementation of the resolution," he said.

Comelec provincial election supervisor Atty. Ellis Miguel said Uy still has remedies to pursue her candidacy since the issued resolution from the First Division is not yet final.

The Comelec en banc will handle the proceedings to determine the case of Uy if her candidacy in the mayoralty seat in Dapitan City will either remain or be cancelled.
