In Falcis brothers’ complaint against Kris Aquino, she is quoted: “we just hire someone to kill for us”

Falcis brothers file complaints of two counts of grave threats against Kris Aquino punishable by up to forty years imprisonment.

It was the turn of Nicko Falcis to go to court and file a criminal complaint against his former boss, actress turned online endorser and influencer Kris Aquino.

Late Friday afternoon, the former managing director of KCAP, Aquino’s online company, along with his brother Jesus Falcis filed a complaint of two counts of grave threats against Aquino before the Office of the City Prosecutor of Quezon City.

In their complaint, the brothers allege the crime was committed on September 27 last year, “respondent Kris Aquino threatened to commit murder..should Nicko Falcis return to the Philippines, to wit:

“YOU FUCKING A**H*** NICKO! xxx

“Huwag ka ng bumalik ng Pilipinas! xxx

“Papatay ka ng pamilya ko! xxx

“Dare to step in this country and you will be DEAD!”

The move of the Falcis brothers came days after an alleged phone conversation between Nicko and Kris went viral online. 

Aquino publicly admitted to being the voice in the leaked recording on Instagram posts and in a Facebook live appearance last January 15. 

In their complaint, Nicko and Jesus said her excuse that she was merely bluffing is false.

As proof they attached an article published on the Manila Times which wrote about an Instagram post Kris later took down wherein she admitted to being the “angry woman in the conversation.”

In this screen grab of the deleted post made through her Instagram account, @krisaquino in the wee hours of the morning of January 15 Aquino said, “I will state the date SEPTEMBER 27, 2018. it is now JANUARY 15, 2019.”

She seemingly dared Nicko to file a case, “Why hasn’t Nicko Falcis filed a case of GRAVE THREATS against me with any prosecutor in October, November, December 2018, or this 1st half of January 2019. 110 DAYS HAVE PASSED. R.A. took meticulous notes from the face to face mtg. A.G. said: Madam, stating the obvious ka naman dun sa: i’m not mabait. R said: Alam mo, inulit mo yung “that bar” with matching hampas ng credit card bill and yung “Coke souvenirs from Atlanta” 8 times nakakaloka ka! i know i should be repentant pero ang hirap talaga kasi nga magna cum laude sya na inside out ng life ko alam. So i know he knew his level of guilt & my inability to make good on my “threat”... Sadly, this has been 1 badly orchestrated demolition job being funded by personalities out for political revenge... i’ll own na kasalanan ko ‘to. Diba kung ang tabihan mo may kuto, sure nang mahahawaan ka? Unforgivable for me? their timing- now that i am so physically weak. oh well, bilog ang mundo.

That post was later replaced by a photo that had the words: “Lesson for Today: January 15, 2019.”

As published in a previous article on this site, the post suggested that Kris was admitting to being the woman in the viral audio file, but was merely bluffing. The caption read [written as is], “Alam naman nya binubwisit ko lang ang life nya that Sept 27... Diba nga magmula nung Sunday night in April, di na kami nagusap ni brother, sa irita nya with me? Honest ako, i’ve seen Noy once in 9 months- in kuya josh’s hospital room- they were all so worried parating sya & i was still in St Luke’s & the guy who was responsible for the recording knew that. #awkward My 3 meek & mild, simple, super prayerful sisters will do harm? Wag naman bilugin ang utak ng tao. You & i know that was a bluff provoked by anger & fear because of my awful health diagnosis.”

In their complaint, Nicko Falcis quoted Aquino as saying, “we just hire someone to kill for us, that’s why we befriend the killers in our circle.”  He alleges that she confided this to him, when their relationship was not yet strained.

Their complaint also included a screenshot of Aquino’s message to Nicko Falcis containing a record of his international travels as proof she had access to Nicko Falcis’ travel records. “And that she will know if Nicko Falcis will indeed comes(stet) back to the Philippines.

The complaint also mentions two body guards who are former members of the Presidential Security Group under the employ of Aquino. “We understand that her body guards carry firearms and have been specially trained to use those firearms to maximum effect.”

The complaint also included screenshots of messages sent to Falcis by Aquino where she asked him to leave the country.

One message, stated, “I am not an evil person Nicko, I have gratitude for you having been there when we started… I am also savvy about what can be done to a person’s reputation when big business starts speculating about the WHYs… I prayed about it & for this to end properly w/ no questions asked- you need to apply for a short term course or any form of studies that will momentarily require your 100% focus & attention… this will be the most credible & believable reason w/ no damage to you & me.” (Emphasis and underscoring supplied from the filed complaint)

According to the Falcis brothers’ counsel, Atty. Regidor A. Ponferrada of Ponferrada Ty Law Offices, “It is our position that the wrong threatened to be committed is Murder. Murder is punishable by Reclusion Perpetua. The penalty which is one degree lower than Reclusion Perpetua is Reclusion Temporal and the duration of Reclusion Temporal under Article 27 of the Revised Penal Code shall be from 12 years and 1 day up to 20 years. Since the crime of Grave Threats is consummated as soon as the threatening remarks are uttered, our position in our complaint is at least two (2) counts of Grave Threats were committed. “

Atty Ponferrada said Jesus Falcis was made a co-complainant “because in Grave Threats, any citizen who has knowledge of the circumstances involving the commission of the crime may also file a complaint.” Jesus can also appear in court for his brother, in case Nicko has to leave the country for safety reasons.

The complaint was filed almost at the close of business hours, at 4:50 in the afternoon.

ANCX has reached out to Aquino’s counsel Sig Fortun for comment. Fortun declined saying, “ I cannot assume I will be the lawyer for those cases. She is still out of the country.”

Divina Law, also counsels of Aquino also declined comment until it has received a copy of the complaint and the subpoena.
