MANILA - Courts allowed authorities to find firearms and other belongings at Parajinog residences 'any time,' documents showed.

In the warrant against Ozamiz Mayor Reynaldo Parojinog, cops were ordered to seize the following in his property in Barangay San Roque: 2 M16 rifles, 1 caliber .45 pistol, 1 M14 rifle, and an undetermined number of other firearms and ammunition.

The 6 search warrants were signed by Executive Judge Cecilyn Burgos-Villavert of the Quezon City Regional Trial Court Branch 89.

The raid on the Parijonogs however yielded not just weapons but also suspected shabu. Ozamiz police chief, Inspector Jovie Espenido, said the police seizing shabu was incidental.

"'Yang search warrant na in-implement during the raid by CIDG is purely for illegal possession of firearms. But incidentally din nakuha ang illegal drugs," he said in a press conference Sunday.

COPS ALLOWED TO SEARCH 'ANY TIME'

The warrants also specified that authorities were allowed to conduct searches at "any time" during day or night, answering questions on the legality of when the raid was conducted.

"You are hearby commanded to make an immediate search at any time of any day or night," said the warrants issued last July 21, 2017.

Critics earlier compared the raid on the Parojinogs, which happened at around 2:30 a.m., to that of Albuera Mayor Rolando Espinosa, who was killed inside detention in the process.

Inspector Espenido was also the police chief in Albuera when the Espinosa was killed. He was transferred to Ozamiz City last December 2016.

THE 'LEGAL TIME' FOR SEARCHES

Amid questions on the proper time to conduct searches, Philippine National Police (PNP) chief Director General Ronald "Bato" Dela Rosa said: "Every time is a legal time to serve search warrants."

According to Dela Rosa, police sometimes serve search warrants in the wee hours to gain advantage over the subject of the warrant.

Espenido earlier said they had to implement the search warrant at around 2:30 a.m to ensure operatives' safety as supporters of Mayor Parojinog held vigil.

"Baka ipagtatapon na ang mga ebidensya e. We have to do it in our own time. We have to dictate the tempo," Dela Rosa said in a press conference on Monday.

Senator Francis "Chiz" Escudero, however, disagreed with the PNP chief, saying the rules of court and even the PNP's revised manual were very clear.

"General Bato is mistaken. He is wrong. The rules of the court is clear. The revised PNP manual itself -- which he should know -- is also clear," Escudero told ANC.

The raid on the Parojinogs resulted to the death of Mayor Parojinog, his wife Susan, his brother Octavio Jr., and 14 others.

His children meanwhile, Vice Mayor Nova Princess and Reynaldo Jr., were arrested and was brought to Camp Crame on Monday.--with reports from Kori Quintos, ABS-CBN News
