Former foreign affairs secretary Albert del Rosario on Tuesday chided the Chinese Ambassador to the Philippines for describing as a "fabrication" the group's communication to hold President Xi Jinping accountable for crimes against humanity.

"I think it's all magical, if that's what he's saying because how did those artificial islands get there if it's all fabrication, if China did not put those illegal structures up, who did?" Del Rosario said in an interview on ANC's Headstart.

"In my five years being Secretary of Foreign Affairs and my dealings with China, there is one certainty that I have been able to find for myself--that when China makes a declaration, you can be sure that it's the opposite of what's happening on the ground," he added.

Ambassador Zhao Jianhua downplayed Monday the communication to the International Criminal Court, adding the move will not prosper.

The Philippines in 2016 defeated China in a United Nations-backed arbitral tribunal, which invalidated Beijing’s economic claim to the strategic sea lane.

However, China has ignored the ruling and insists it has sovereignty over the waters.

President Rodrigo Duterte has chosen to set aside the ruling in exchange for better economic ties with Asia’s largest economy. ANC Headstart 2 April 2019
