MANILA - The Office of the Ombudsman has ordered the dismissal of Bacolod-Kalawi, Lanao Del Sur Vice Mayor Diarangan Dipatuan after he was found guilty of grave misconduct for the under-remittance of contributions of a complainant to the Government Service Insurance System (GSIS).
The Ombudsman also ordered the dismissal of treasurer Rasad Dumarpa.
In a statement, the Ombudsman said complainant Habib Tarosan went to the GSIS office in Iligan City in December 2015 and found that his supposed contributions were under-remitted.
Instead of declaring Tarosa's actual salary, the 2 officials declared lower pay, resulting in lower monthly premium contributions.
Based on the record of 2012 remittances from January to December, Tarosan's declared salary was only P14,179 per month when his actual received salary was at P20,367 per month.
“As a result, the monthly premium computed was lower because of the incorrect salary factor. This only proves that there was a failure, refusal, or delay in the payment, turnover, remittance or delivery of the correct premium contributions to the GSIS using the formula provided in the GSIS Act,” the Ombudsman said.
The Ombudsman also emphasized that Dipatuan and Dumarpa are the “accountable officers for the collection and remittance of the correct premiums to the GSIS."
In the event of separation from the service, the Ombudsman also said that the penalty is convertible to a fine equivalent to respondents’ salary for one year.
The Office of the Ombudsman also said that a check with the PAG-IBIG Fund in Iligan City revealed that Bacolod-Kalawi failed to remit the municipality’s contributions.
