'Bakit 1 taon?': Minorya pumalag sa hiling na martial law extension sa Mindanao

Mismong mga naunang pahayag nina Pangulong Rodrigo Duterte at Defense Secretary Delfin Lorenza ang ginamit ng ilang mambabatas upang kontrahin ang hiling na martial law extension sa Mindanao.

Sa kaniyang pagtatanong sa joint session ng Kongreso upang talakayin ang nais ni Duterte na 1 taon pang martial law, pinaalala ni Sen. Franklin Drilon na idineklara nang "malaya" mula sa teroristang grupo ang Marawi noon pang Oktubre 23.

Tugon naman ng administrasyon, aktibo muling nangangalap ng miyembro ang iba pang grupo sa Mindanao. 

"The battlefield has now moved to other places in Mindanao," ani Executive Secretary Salvador Medialdea.

"As [the] situation developed later on, the other ISIS-inspired groups in Mindanao have become active, like the BIFF in Central Mindanao...The report now is that they're actively recruiting again," dagdag naman ni Lorenzana.

Pero giit ni Drilon, walang basehan ang deklarasyon lalo pa't ito'y banta pa lamang at hindi pa nangyayari.

"The Constitution is clear that Congress can only extend the proclamation of martial law in case of an actual public uprising and taking of arms against the government."

Kinuwestiyon naman ni Senior Deputy Minority Leader Lito Atienza kung saan humugot ng legal na basehan ang administrasyon para sa isang taong martial law, na maaari umanong paglabag sa intensyon Saligang Batas. 

"Ito pong ating pinag-uusapang extension ay one year. In the Constitution, as constructed in 1986 and 1987, the country coming out of an unlimited martial law decided never again should it be allowed. So I question the very nature of request for one year," ani Atienza.

Ayon naman kay Senador Risa Hontiveros, hindi makatutulong ang martial law sa pagsugpo sa kadedeklara pa lamang na teroristang New People's Army (NPA).

"As a former peace panel negotiator, I know that martial law or any repression of civil liberties actually spikes NPA recruitment," paliwanag ni Hontiveros.

Pero ayon kay Lorenzana, ibang teroristang grupo ang pangunahing target ng martial law at hindi NPA.

"There is an intensification of attacks of the NPA especially in the Eastern Mindanao and also in Southern Mindanao. But they're not actually the main target of martial law but the continuing rebellion of ISIS-inspired groups," ani Lorenzana.

Sinita rin ni Hontiveros ang sulat ni Duterte sa Kongresa na sinabing isa ang pagbuo muli ng Marawi sa mga basehan niya sa paghiling ng martial law extension.

"Rehabilitation and socioeconomic growth are not the objectives of a declaration of martial law," aniya.

Pero tugon ni Senior Deputy Executuve Secretary Menardo Guevarra, bukas sa interpretasyon ang konsepto ng martial law.
 
"Martial law is a flexible concept but it is understood to be an exercise of police powers by the executive with the assistance of military to ensure public safety," sagot ni Guevarra kay Hontiveros.
