MANILA – Senior Associate Justice Antonio Carpio will take the high court's helm in acting capacity, Court Administrator Midas Marquez said Friday.

This as President Rodrigo Duterte has yet to pick his choice of chief magistrate while Chief Justice Lucas Bersamin has retired.

Carpio, the most senior member of the high court, is also set to retire on Oct. 26.

Marquez said Carpio's ascent as chief magistrate no longer needs formal appointment or a resolution as such succession is under jurisprudence.

Carpio has held the post of acting chief magistrate several times prior to appointments of chief justices, being the most senior member of the high court.

He has declined nomination to the post on several occasions, including after the May 2018 ouster of then Chief Justice Maria Lourdes Sereno.

Carpio has been with the Supreme Court since October 2001.

Among those in the running for Chief Justice are Supreme Court Associate Justices Diosdado Peralta, Estela Perlas-Bernabe, and Andres Reyes Jr.
