Ex-Davao Oriental mayor fined for refusing to dismiss employees

MANILA - The Office of the Ombdusman has ordered former Lupon, Davao Oriental Mayor Domingo Lim to pay a fine equal to his one month’s salary as mayor after refusing to implement the dismissal order against some of his municipal employees. 

Lim was found guilty of simple neglect of duty after failing to implement the September 17, 2015 order of the Ombudsman to dismiss Zaldy Cloe, Jonel Delmonte, Renato Lanos, Rhulan Patiño Sr., Romeo Rosauro, and Sani Hanani. 

The Office of the Ombudsman noted that Lim was reminded twice of the immediately executory nature of the decision and the repercussion of his failure to comply with the order. 

In his defense, Lim said that he merely exercised prudence in seeking the legal opinion of the Ombudsman-Mindanao because he is not “learned in the law”. 

He also claimed that he should be guided by the Ombudsman in implementing the dismissal order in the midst of the “grey areas” that arose from the legal remedies availed of by the dismissed municipal employees.
