MANILA—Presidential Spokesperson Harry Roque on Saturday dared Sen. Antonio Trillanes IV to show his amnesty application form.
This after President Rodrigo Duterte invalidated Trillanes' amnesty for failing to comply with minimum requirements such as personal filing of the application form and admission of guilt.
"Ang dami po niyang pinapakita, ang dami niyang sinasabi, nasaan 'yung duly received application form niya? Kung nawawala, sabihin niyang nawawala pero hindi naman pwedeng sabihin niya na wala siyang kopya," Roque told radio DZMM.
"Kung hindi mahanap 'yung kopya ng DND (Department of National Defense) ang dapat niyan pakita niya 'yung kopya niya kasi lahat naman 'yan kapag nag-file ka may received copy. So tigil na po ang satsat, nasaan yung duly received application form niya? Best evidence rule kapag nakasulat po 'yan, 'yung kasulatan ang ebidensiya."
Roque said Trillanes' amnesty application is essential because it contains his admission of guilt.
" 'Yung pangalawang requirement ay 'yung pag-amin. So kung wala kang mapakitang application, wala rin 'yung second requisite na pag-amin kasi nandu'n 'yun sa form," he said.
The DND earlier said that the original copy of the senator's amnesty application form was "missing."
Trillanes on Tuesday showed senators a video of him filing his amnesty application form as he sought to debunk the basis of Duterte's proclamation nullifying his amnesty.
The senator also provided documents revealing that the coup d'etat and rebellion cases against him were already dismissed in 2011 as the Department of Justice sought arrest warrants and hold departure orders against him.
Trillanes has also presented documents that proved he exited military service and cannot be arrested through a military court order.
