PNP-IAS seeks Palace nod to charge former Caloocan police chief
After filing administrative cases against the 17 policemen accused of involvement in Kian Delos Santos' death, the Prosecution Division of the PNP-Internal Affairs Service (PNP-IAS) said the policemen will now go through summary dismissal proceedings.
PNP-IAS Inspector General Alfegar Triambulo, said they found probable cause to file administrative cases of grave misconduct, serious irregularity in the performance of duty, and serious neglect of duty against the 17 cops.
"Findings ng prosecution division, may probable cause ng tatlong kaso, 'yung grave misconduct natin, 'yung illegal arrest at pagpatay kay Kian," Triambulo said.
The PNP-IAS also noted several violations of police operational procedures in the operation conducted by the Caloocan Police.
"Yung pag-violate ng police operational procedures, tulad ng hindi pag-uniporme, walang mga dokumento, tulad ng pre-operation incident report, pre-operation report at iba pa. Iyon po ay serious irregularity in the performance of duty," Triambulo added.
The station commander of PCP Station 5, Chief Inspector Amor Cerillo, and former Caloocan police chief Senior Superintendent Chito Bersaluna were also not spared from the administrative charges.
"Meron din tayong serious neglect of duty doon sa mga supervisor and superior dahil sa pagpabaya nung pag-supervise ng kanilang mga tauhan," Triambulo said.
The PNP-IAS still has to get a presidential clearance in order to file administrative charges against Bersaluna because he is a presidential appointee.
"Kay Bersaluna, naka-deferred po 'yung filing ng kanyang command responsibility and serious neglect of duty dahil siya ay hingan pa po ng clearance po sa Malacanang dahil merong circular ang National Police Commission na pag yung presidential appointee tulad nung senior superintendent, tulad ng ranggo ng chief of police, kelangan po muna ng clearance bago po sampahan ng kaso para i-subject ng summary dismissal proceeding ang kanyang kaso," Triambulo said.
The rest of the policemen will undergo summary dismissal proceedings and will be required to submit a position paper. In 30 days, the PNP-IAS will submit its recommendations to PNP chief Ronald dela Rosa.
"Mag-a-assign ng hearing officer para mag-conduct ng summary dismissal proceedings so again, ayon sa circular ng Napolcom, sila po ay papadalhan ng summons requiring to submit their answer to the formal charge and then, afer ng itinakdang araw, seven days ayon sa rule, ise-set po natin ng pre-hearing conference kung saan mag-meet po ang dalawang parties, respondent at kanilang mga testigo saka yung ating prosecution division o prosecutor, mamarkahan ang mga ebidensiya ng bawat panig. Sila po ay mag-uusap para mapadali o ma-dispose ang kasong administratibo," Triambulo explained.
"Para madali po hindi na natin kailangan ng trial type, position paper, merong 30 days ang hearing officer ng IAS to resolve the case and submit drafting recommendation. Pag-na-aaprove ko, 'yan ay pipirmahan ni Chief PNP," he added.
