Court dismisses election protest vs Negros Occidental mayor

MOISES PADILLA, Negros Occidental -- A court here has dismissed an election protest case lodged against Moises Padilla Mayor Ella Garcia-Yulo, saying allegations of election fraud were not established given the wide vote margins between the elected official and her political rival.

Yulo garnered 13,056 votes in the midterm elections, defeating former Moises Padilla mayor Magdaleno Peña who got 5,493 votes.

The court also dismissed Peña's request to check ballots from several precincts, according to the 25-page order issued by Bacolod City Regional Trial Court Branch 49 Judge Edgar Tupas.

The court earlier dismissed murder charges filed against Yulo.

In April, Yulo survived a gunning incident that killed her sibling and another relative who was running for councilor.

The incumbent mayor of Moises Padilla is seeking for P1.2 million in damages.
