Police open to internal affairs investigation after rape-slay suspect's death

The Philippine National Police—Anti-Kidnapping Group (PNP-AKG) is open to any investigation by the PNP Internal Affairs Service (PNP-IAS) after Hilario "Larry" Herrera, the kidnap-rape-slay suspect in their custody, allegedly shot himself inside the AKG compound Tuesday night. 

According to PNP-AKG Director Police Senior Superintendent Glenn Dumlao, Herrera had just come from his inquest proceedings at the Department of Justice with his two police escorts — Senior Police Officer 1 Grant Chaluyen and Police Officer 3 Felix Parafina — when he arrived at Camp Crame at about 8:55 p.m. 

On their way to his detention cell at the second floor of the AKG building, police alleged that Herrera grabbed the service firearm of Parafina and shot himself in the head.

"Pababa sila and, of course, dalawa lang iyong guwardiya na naiwan sa kanya na papunta na doon, pababa ng van namin and accordingly grinab na iyong service firearm nung nauna sa kanya at ipinutok niya sa sarili niya. Sabi ng mga escorts nang na-interview naming, nabigla rin sila kasi maghapon din sila and they don't expect na ganun ang gagawin niya," Dumlao said.

The escorts immediately brought Herrera to the PNP General Hospital but was pronounced dead on arrival. 

In a press conference at Camp Crame Wednesday morning, Dumlao said his unit will welcome any investigation.

Dumlao said the police escorts followed protocol and they don't see any irregularities related to the incident. 

"Nandito sila sa amin kasi unfair naman na ire-relieve mo. They are doing their job and ang lakas nito. Sabi nila ang lakas. Tangkad," Dumlao said.

According to Dumlao, in order to get to Herrera's detention cell, the group had to pass through a dark, narrow hallway where only two people can fit comfortably. When Herrera saw an opportunity, he allegedly grabbed the gun of one of the police escorts.

"Aisle iyon. Hindi pwede magkasya lahat. Pagpasok doon aisle," Dumlao added.

According to Dumlao, they did not expect the incident to happen.

"Whatever kasi dalawang bagay lang iyan. Una, he is a parolee. Remember, 10 years nasa Iwahig Penal Colony. Ano kaya ang nag-udyok sa kanya?" Dumlao said.

"Rape ang kaso mo babalik ka dyan, naku papatayin ka rin. Meron silang tradition doon. Kapag rape ka, better murder and kaso mo. Second, remorseful siya. Inampon siya ng pamilya, pinakain."

A PNP-Internal Affairs Service investigation is underway. 

"As far as we are concerned, we stand by sa statement nila at alam namin iyong feeling na mag-escort ng buong araw hindi ba," Dumlao said.

Parafina has undergone a paraffin test and has turned over his service firearm to the investigating body.

"Pina-paraffin test na rin namin iyong dalawang security escorts. Ang SOP is nakaposas kaya nga effective immediately ang sabi ko dito sa likod ang posas," Dumlao said.

In the meantime, the PNP-AKG has no plans of relieving the police escorts.
