MANILA – Former Ilocos Sur Rep. Salacnib Baterina has asked the Sandiganbayan 2nd Division to dismiss the graft charges filed against him over the alleged misuse of congressional funds.
Baterina cited "inordinate delay," the same ground used by other accused individuals in cases already dismissed by the anti-graft court.
Baterina is facing three counts of graft and three counts of malversation of public funds for the alleged misuse of P33.9 million of his Priority Development Assistance Fund (PDAF).
In his urgent motion submitted to the court, Baterina said the cases should be "dismissed as having been filed after a period of inordinate delay of three years, three months and ten days."
Baterina also accused the Ombudsman of "flawed preliminary investigation" after his counter-affidavit was either "lost or concealed" which supposedly violated his right to due process.
