MANILA—Former Solicitor General Florin Hilbay said on Thursday night that he doesn't like Chief Justice Maria Lourdes Sereno's chances of getting a favorable ruling in the face of a quo warranto petition against her.
"Baka fearful forecast. Mukhang maugong 'yung balita. Malaki ang tsansa na mangyari 'yung kinakatakutan ng marami na mag-desisyon ang Korte Suprema at 'yung kanilang desisyon ay i-grant 'yung petition for quo warranto," he said in a Bandila DZMM interview.
Should the majority of justices decide to unseat Sereno, Hilbay said the chief justice could still file a motion for reconsideration.
"Kapag sinabi ng majority na tatanggalin siya, si CJ ay CJ pa rin. Puwede siyang mag-file ng motion for reconsideration," he said.
But if the high court's decision is immediately executory, it would finally seal Sereno's fate.
"Malabo na siyang makabalik . . . Tanggal na siya. Puwede siyang paalasin na dahil hindi na siya empleyado ng Korte Suprema," Hilbay said.
Though abuzz with rumors of Sereno's impending ouster, he still sees a glimmer of hope for the chief justice.
"Between now at sa pagboto nila, puwedeng maraming mangyari. I'm sure nag-iisip ang mga mahistrado natin kung ano ang tamang gawin dito," he said.
In the interview, Hilbay also stood firm that Sereno couldn't be removed through a quo warranto petition.
"Sa akin po, malinaw naman kahit tanungin 'yung mamamayan at kahit mga law students na kapag sinabi mo ang isang public official ay impeachable, the only way for you to remove that person is via impeachment," he said.
The petition for quo warranto, filed by Solicitor General Jose Calida, claimed that Sereno was "unlawfully holding" her post due to her alleged failure to fully disclose her wealth.
