Hilbay: Aquino can't be held liable for Mamasapano carnage

MANILA - Former Solicitor General Florin Hilbay said former president Benigno Aquino III should not be held liable for the 2015 Mamasapano massacre that killed 44 elite policemen.

According to Hilbay, Aquino gave an order to a subordinate, but that subordinate failed to do what was asked of him.

"Sa aking pananaw, nagbigay siya ng isang utos sa kaniyang subordinate. Hindi nagawa ng kaniyang subordinate ang utos na 'yun. Hindi puwedeng managot ang isang pinuno sa kamalian ng kaniyang subordinate," he said during " Harapan 2019: The ABS-CBN Senatorial Town Hall Debate" on Sunday.

(In my opinion, he gave an order to a subordinate, but his subordinate failed to follow his order. A leader can't be held liable for his subordinate's failure.)

Hilbay also said it is better to wait for the decision of the courts with regards to Aquino's liability in the Dengvaxia controversy.

'Yan po ay isang usaping legal. Hindi po natin masasagot 'yan dahil 'yan po ay nasa korte. Kung may responsibilidad ang presidente, dapat ang korte ang magsabi," he said.

(That is a legal issue. We cannot answer that because the case is still in court. If the president is responsible, the court should be the one to decide.)

Hilbay, likewise, expressed approval to the use of medical marijuana, legalization of same-sex marriage in the country and the passing of a divorce law.

When asked whether senators should have college degrees, Hilbay said it should not be required to provide equal opportunity to everyone.

"Hindi kailangan. Dahil dapat ang bawat Filipino ay magkaroon ng access sa ating mga public positions. Hindi kailangang maging college graduate ang mga senador. Dapat ang mga mamamayan ang magdesisyon," he said.

(It should not be required, since every Filipino should be given access to public positions. Senators are not required to have a college degree. It should be the people who will decide.)

Hilbay is running under the Aksyon Demokratiko political party and is also a candidate of the opposition coalition.

A known critic of President Rodrigo Duterte, Hilbay served as solicitor general during the presidency of Aquino.
