SC orders DBM, Diokno to file comment on Andaya petition

MANILA - The Supreme Court (SC) has directed the Department of Budget and Management (DBM) and Secretary Benjamin Diokno to comment on the petition filed by former House Majority leader and now House appropriations committee chair Rep. Rolando Andaya, Jr.

Andaya filed a petition before the high court last week to compel the DBM to release the 4th tranche of salary increase for state workers.

Diokno earlier said he had no legal basis to release just yet the 4th tranche of salary increase because Congress has yet to pass the 2019 budget. The 2018 budget, he said, only covers the 3rd tranche of increase.

But Andaya insisted the DBM could use the Miscellaneous Personnel Benefits Fund amounting to around a hundred billion pesos from the reenacted 2018 budget to cover the amoung needed for the 4th tranche of increase, or use the savings from the 2018 budget.

The passage of the 2019 budget was stalled after some senators questioned alleged pork barrel insertions by House lawmakers.

The Senate on Monday finally passed the P3.757-trillion 2019 budget. 

The bill will go through the bicameral conference committee to thresh out differences between the Senate and House versions before going to the President for signature.
