MANILA - The Office of the President has ordered a 60-day preventive suspension order against Cebu City Mayor Michael L. Rama for alleged culpable violation of the constitution, grave abuse of authority, grave misconduct and oppression.

The suspension order will be implemented by the Department of Interior and Local Government (DILG) pending the investigation of the charges filed against Rama.

Barangay Labangon Chairperson Victor M. Buendia filed an administrative complaint against Rama last year for alleged unilateral act of the mayor, without due process and lawful authority, of ordering the destruction and demolition of a center island and street lighting project in the said barangay.

The said project was funded and undertaken by Barangay Labangon.

According to the suspension order, "street lights and center islands are not nuisances per se since they are not, in themselves, a menace to public health or safety," making it unlawful to demolish it without due process.

"Indeed, they are usually constructed precisely to enhance the safety of pedestrians and the motoring public. Not being nuisances per se, such structures could only have been lawfully demolished, if at all, through the appropriate proceedings in court," the order also stated.
