MANILA -- After three decades, the Antipolo Regional Trial Court (RTC) branch 97 has junked the double murder case filed against a former Air Force lieutenant colonel accused for the deaths of former Kilusang Mayo Uno leader Rolando "Ka Lando" Olalia and Leonor Alay-ay.
According to Atty. Edre Olalia, member of the National Union of People's Lawyers and one of the private prosecutors in the case, RTC Judge Marie Claire Mabutas-Sordan granted a demurrer to evidence or motion to dismiss petition filed by the accused, Lt. Col. Eduardo Kapunan.
Olalia rued the decision, saying they have solid evidence for the case.
He cited two state witness who named Kapunan as the mastermind of the brutal murder of Olalia and Alay-Ay.
In 1998, Sgt. Medardo Barretto and Sgt. Eduardo Bueno of the Rebolusyonaryong Alyansang Makabayan who allegedly participated in the abduction of Olalia and Alay-Ay, surfaced and gave their statements.
Olalia said the prosecution will file a motion for reconsideration in Court.
Olalia and Alay-ay were abducted, tortured, and killed in November 1986.
