READ: The MILF report on the Mamasapano incident

MANILA - The Senate on Tuesday said it has received a copy of the Moro Islamic Liberation Front report on its investigation on the Mamasapano firefight last January 25.

In the report, the MILF Special Investigative Commission said the Bangsamoro Islamic Armed Forces were justified in fighting back after it was fired upon by elements of the Philippine National Police-Special Action Force 55th Special Action Company in Barangay Tukanalipao on the day of the encounter.

"Without proper coordination, the BIAF did not know that the forces in Sitio Amilil were government forces with whom there is a holding ceasefire agreement. When they were fired upon in the wooden bridge of Tukanalipao, the BIAF could not have done anything else but to fire back as two of their men were instantly killed in the assault of the PNP-SAF men," the report said.

The report said that if there is any liability on the part of MILF fighters during the clash, the disciplinary action should be carried out by the MILF.

It also said a viral video showing the killing of a SAF trooper "does not clearly identify the killer as one of the members of the BIAF."

The report said the MILF should file a protest regarding the violation of the cease-fire by the PNP-SAF.

It also said the taking of "war booties" or weapons and other personal effects of the SAF "is justified in international law." It, however, said these items were returned to the government.

The report also said there was "failure of intelligence" in the MILF 105th and 106th Base Commands to monitor the entry of Malaysian terrorist Zulkifli bin Hir, alias Marwan, and Basit Usman to the area.
