Who should pay tax for Hummer? Boy or Kris?

MANILA -- Days after Kris Aquino gave close friend and talk show partner Boy Abunda a Hummer, the Bureau of Internal Revenue (BIR) on Wednesday clarified that usually the one who gave the present should shoulders the donor's tax.

In an interview on DZMM, BIR Commissioner Kim Henares said that the giver should shoulder the donor's tax, which is equivalent to 30% of the price of the gift.

"Narinig ko kahapon na pinag-uusapan din nila na magbabayad daw sila ng donor's tax... Sinasabihan niya (Aquino) si Boy Abunda na dapat siyang magbayad ng donor's tax," Henares said.

However, she quickly explained that this matter may be settled between the donor and receiver of the gift.

"Actually, ang nagbabayad 'yung nag-donate," she said. "Pero pwede niyo namang pag-usapan doon sa tumanggap na siya na lang magbayad."
