MANILA, Philippies - The Court of Appeals (CA) did not issue an ex-parte temporary restraining order (TRO) or writ of preliminary injunction in favor of ABC Development Corporation (TV5) in its petition against the Movie Television Review and Classification Board's (MTRCB) 20-day suspension order on the former's program, T3.
Instead, through a resolution dated May 14, the appellate court's First Division called for a hearing on TV5's plea on May 16, 2 p.m., to give both sides the chance to agree on whether there is merit to grant petitioner's plea for the temporary relief.
"The parties are required to attend the hearing on Wednesday, May 16, 2012, 2:00 in the afternoon, Paras Hall, on petitioner's prayer for temporary restraining order (TRO) and/or writ of preliminary injunction, as contained in its petition for certiorari and prohibition dated May 11, 2012," the resolution read.
The MTRCB suspended T3, a program of Tulfo brothers Ben, Raffy and Erwin, stemming from the brothers' on-air remarks against celebrity couple Raymart Santiago and Claudine Barreto after both figured in a brawl with the 3 hosts' eldest brother, Mon.
The petition sought the nullification of the MTRCB order for "being unconstitutional and for having been issued without jurisdiction or with grave abuse of discretion amounting to lack of or excess of jurisdiction."
