MANILA - The Supreme Court (SC) has upheld its ruling ordering the transfer and relocation of the Pandacan oil depot.
The high court en banc, during its Tuesday session, junked the motion for reconsideration (MR) that sought a reversal of the November ruling on the unconstitutionality of Manila City Ordinance No. 8187 which allowed the continued stay of the depot.
In its November decision, the high court said the oil depot had to go because it violates "the right to health and the right to a healthful and balanced environment."
The high court ordered oil companies operating in the depot to submit a comprehensive plan to Manila Regional Trial Court (RTC) Branch 39 for their relocation.
Ordinance No. 8187 was passed during the term of Manila Mayor Alfredo Lim.
Lawyers Vladimir Cabigao and Samson Alcantara of the Social Justice Society, Buhay party-list Rep. Lito Atienza, and former Manila Rep. Bienvenido Abante went to the SC to question the ordinance.
