MANILA (UPDATED) - The House justice committee on Thursday officially junked the impeachment complaint against Comelec Chairman Andres Bautista.
Voting 26-2, the lawmakers approved the justice committee report that dismissed the impeachment complaint for being insufficient in form.
The vote earlier was 19-2 but the lawmakers moved to reconsider this after Ilocos Norte Rep. Rodolfo Fariñas said all members of the panel should participate in the voting.
"We only had 19 votes earlier and that is not sufficient," said Fariñas.
The House justice committee on September 20 dismissed the complaint because of its defective verification, a basis used in previous decisions by the committee.
The impeachment complaint against the Comelec chief stemmed from allegations of unexplained wealth accused by his estranged wife Patricia "Tish" Bautista.
The complaint was filed by lawyer Ferdinand Topacio? and former Negros Oriental Rep. Jacinto Paras, and was endorsed by representatives Harry Roque of the Kabayan party-list and Gwen Garcia of Cebu.
