MANILA - The Sandiganbayan 3rd Division has reset to Nov. 10 the arraignment of dismissed Makati City Mayor Junjun Binay for his graft and falsification of public documents cases stemming from the controversial construction of the Makati City Hall Building 2.
This after Binay's lawyer Joseph Castillo told the court that they have just received the copy of its decision denying their motion for reconsideration on the judicial determination of probable cause.
The ruling, promulgated on Sept. 25, had rejected Binay's plea against his indictment, paving the way for trial to proceed.
Lawyer Estelito Mendoza, counsel for project contractor Hilmarc’s Construction Corporation Chairman Efren Canlas, said they received the copy of the decision a few minutes before the start of the hearing.
Because the parties were informed late of the court’s decision, Presiding Justice and 3rd Division Chair Amparo Cabotaje-Tang said in open court that the arraignment was cancelled and reset to November.
