Cebu road rage suspect David Lim Jr., was ordered released by a local court Thursday after he posted a combined P144,000 bail for two criminal complaints.
Regional Trial Court Judge Ricky Jones Macabaya ordered Lim's release after the suspect posted P24,000 bail for the complaint of frustrated homicide filed by the victim, nurse Ephraim Nuñal.
Prosecutor Liceria Rabillas said the complaint was downgraded from frustrated murder to frustrated homicide because the element of "treachery" was absent in Lim's case.
For the illegal ammunition complaint, Judge Alexander Acosta ordered Lim's release after the latter posted bail of P120,000.
Lim is the primary suspect in the road rage shooting of Nuñal in a traffic altercation in Cebu City. The incident was caught on camera.
He turned himself in to the police after his mother negotiated for his safe surrender through the help of President Duterte's top aide Christopher Go.
Nuñal’s lawyer Mundlyn Martin said in a statement that while they respect the right of the accused to post bail, they hope Lim will not resort to any more violent acts against anyone, “most specially my client, the witnesses and their respective families.”
Despite the downgrading of their case to frustrated homicide, Martin also said they still have “complete faith and belief in the [justice] system.”
Bodyguards were sighted outside Lim's cell Wednesday afternoon despite a denial from PNP chief Ronald dela Rosa that Lim was receiving VIP treatment in detention.
