Self-confessed drug kingpin Kerwin Espinosa has formally participated in the complaint before the Department of Justice (DOJ) on the killing of his father, Albuera, Leyte Mayor Rolando Espinosa.
In today's continuation of the preliminary investigation into the incident, Espinosa joined as private complainant in the case earlier lodged by the National Bureau of Investigation (NBI) against 24 policemen led by Supt. Marvin Marcos.
The NBI is accusing Marcos and his group of multiple murder, robbery, malicious procurement of a search warrant and perjury.
The elder Espinosa was killed at a sub-provincial jail on November 5, 2016 while policemen led by Marcos were serving a search warrant on him. Another inmate, Raul Yap, was also killed.
The policemen claimed Espinosa had a firearm inside his cell while Yap was in possession of illegal drugs. They also claimed that Espinosa and Yap put up a fight.
The respondents filed their counter affidavits where they insisted that what happened was a shootout.
In its complaint, however, the NBI alleged that what took place was a rubout, and not a shootout.
The police operation and deaths of the two inmates became the subject of a congressional inquiry last year.
