MANILA, Philippines (UPDATE 1) - The Supreme Court (SC) has issued a Writ of Kalikasan in favor of Agham party list, represented by its president, Rep. Angelo Palmones, which filed a petition against LNL Archipelago Minerals, Inc., the Department of Environment and Natural Resources (DENR), Philippine Ports Authority (PPA), and the Zambales Provincial Police Office.
The petition was filed in connection with the alleged destruction of the natural barriers of Zambales province from typhoons and floods.
Various groups in the locality have been calling for the urgent stoppage of mining activities and the cutting and leveling of a mountain in Barangay Bolitoc, Sta. Cruz town.
No temporary environmental protection order (TEPO) was issued, which means that while respondents are compelled to answer the charges, the mining activities are not ordered stopped immediately.
The issuance of the writ compels respondents to submit a verified return which shall contain "all defenses to show that respondent(s) did not violate or threaten to violate, or allow the violation of any environmental law, rule or regulation or commit any act resulting to environmental damage of such magnitude as to prejudice the life, health or property of inhabitants."
The special civil action was ordered remanded to the Court of Appeals (CA) for hearing and reception of evidence.
