MANILA, Philippines - The Sandiganbayan First Division has given the prosecution 5 days to file a comment on the motion for reconsideration filed by the camp of Dinagat Islands Rep. Ruben Ecleo,Jr. asking the court to reconsider the writ of execution it ordered against his properties as he still has a pending petition for review with the Supreme Court after the Sandiganbayan convicted him.
Atty. Jose Ventura Aspiras, Ecleo's legal counsel, said the writ of execution was issued to satisfy the monetary judgment against Ecleo by the court and two others amounting to P2.8 billion representing the alleged overpayment made by the local government of then Surigao del Norte, for the construction of a public market and the alleged use of public funds for the repair of a guesthouse owned by a private organization.
"We are asking the court not to implement this in the meantime that we have a pending petition with the Supreme Court. We also attached pictures of the Ublic market na tapos na ito at hindi half-finished gaya ng mga sinasabi ng nagsampa ng kaso kay Rep. Ecleo, which only goes to show na walang dapat ikaso dahil matagal ng nakatayo yun palengke."
The court gave Ecleo's camp 7 days to reply to the prosecution's comment.
