Ex-mayor convicted for illegal appointment

MANILA - The Sandiganbayan has convicted former Lianga, Surigao del Sur Mayor Felino Pantaleon Jr. over an illegal appointment back in February 2007.

In a statement released on Wednesday, the Sandiganbayan said Pantaleon violated Article 244 of the Revised Penal Code, which declares it unlawful for any public officer to knowingly nominate or appoint to any public office any person lacking legal qualifications.

It said the Office of the Ombudsman was able to prove that Pantaleon illegally appointed Ian Reigh Elimanco as Local Civil Registrar despite lacking the qualification of 3 years of relevant experience.

According to the Sandiganbayan, the Sanggunian had disapproved Elimanco's appointment, but Pantaleon still upheld his appointment.

"There is no doubt that Mayor Pantaleon was fully aware that Elimanco is not qualified for the position at the time the appointment was issued due to the latter's want of experience in civil registry works," its decision read.

The Sandiganbayan sentenced Pantaleon to imprisonment ranging from 1 to 2 months and a fine of P1,000.
