SC says ARMM polls postponement constitutional

MANILA, Philippines - The Supreme Court on Tuesday junked a motion for reconsideration on its decision upholding the constitutionality of Republic Act 10153 that deferred the Autonomous Region in Muslim Mindanao elections to 2013 and allowed the President to appoint officers-in-charge (OICs).

SC Spokesman Jose Midas Marquez said the SC en banc voted 8-6 to uphold RA 10153. The eight SC magistrates who voted to uphold RA 10153 are Arturo Brion, Diosdado Peralta, Martin Villarama, Jose Mendoza, Mariano del Castillo, Bienvenido Reyes and Estela Perlas-Bernabe.

The 6 who voted against are Antonio Carpio, Teresita Leonardo-de Castro, Jose Perez, Lourdes Sereno, Presbitero Velasco and Roberto Abad.

Chief Justice Renato Corona, who voted to strike down RA 10153 in October, inhibited in today's voting because the respondent in one of the cases/petitions is the Senate, and he is being tried by the Senate now sitting as an impeachment court.
