Gatdula's plea to transfer probe to Manila junked
MANILA - The Department of Justice (DOJ) panel of prosecutors hearing the preliminary investigation into frustrated murder charges against former National Bureau of Investigation (NBI) Dir. Magtanggol Gatdula in connection with the failed ambush of deputy Dir. Reynaldo Esmeralda junked Gatdula's plea for a transfer of the investigation to the Manila City Prosecutors Office.
The panel, composed of assistant state prosecutors Gerard Gaerlan, Rassendel Rex Gingoyon, and Gino Paolo Santiago said Gatdula's motion lacked merit.
Gatdula's camp, in an attempt to seek a reversal of the ruling, filed a motion for reconsideration (MR). Esmeralda was given 5 days to file his reply.
Other respondents, Tyrone Ong and Gino Eustaquio, meantime, filed their respective counter affidavits.
The panel will rule on Gatdula's MR first before scheduling the next hearing.
Esmeralda and his brother survived the ambush try on Feb. 20 in Manila.
Gatdula denied he was behind the attempt, alleging it was an “ambush me” incident staged by Esmeralda which, he claimed, he was being framed up for.
