MANILA, Philippines - The case filed by the wife of a state prosecutor against her husband in connection with his alleged infidelity, and the case filed by the prosecutor against her is now with the Department of Justice (DOJ).

Prosecutor General Claro Arellano bared the Quezon City Prosecutor's Office, where the complaint was first filed, had inhibited from hearing the case because the prosecutor is one of their own.

The married male prosecutor and her alleged girlfriend, a former lawyer of the Public Attorney's Office (PAO), figured in a recent sex video scandal.

"Ang pagkakalaam ko, nag-file na ng kaso sa Quezon City yung asawa ng prosecutor. Ang nakausap ko yung City Prosecutor ng Quezon City, si chief Donald Lee, ang sabi niya finorward na sa amin (DOJ main) yung kaso. Mag-iinhibit sila kasi kasama nila sa Quezon City Prosecutor's [Office] yung involved dito," Arellano said.

Initial information that has reached the DOJ revealed that the alleged sex video was taken last year, when the state prosecutor was still not part of the DOJ family. He only became a state prosecutor last October. His female partner is already in the US.

Arellano assured the public that the complaint against the prosecutor will be decided based on its merits alone.

"Walang magiging white wash dito. Pag may kasalanan ang prosecutor namin, fafilan namin siya ng kaso. Basta palaging magiging meritorious ang pag-eevaluate namin dito sa kaso. Hndi porket prosecutor namin, ililibre namin," Arellano said.

Asked if the incident has cast a negative image on public prosecutors, Arellano agreed.

"Nakakasira nga etong mga sex video na 'to lalong lalo na ang involved dito ay isang prosecutor na dapat maging ehemplo ng moralidad," he said.
