Gen. Carlos Garcia shame on you. Special treatment for you is out of question. You will be treated just like the other accussed of wrong doings. Your family is not out of the hook. I pray that you will be convicted together with your family.

MANILA - Retired Major Gen. Carlos F. Garcia, former comptroller of the Armed Forces of the Philippines (AFP), welcomed on Tuesday the Supreme Court (SC) ruling that the Sandiganbayan cannot proceed with trial on 2 forfeiture cases against his wife and 3 children because of improperly served summons.
In an interview after his hearing at the graft court's Fourth Division, Garcia said he expects that the Sandiganbayan resolution declaring them in default for not submitting their answers to the government complaint will now be lifted.
"We filed the petition five years ago. I'm glad it was decided in our favor. Now the forfeiture cases are back to ground zero," he said.
The accused former military general admitted that he is having difficulty coping with the slow proceedings particularly since he has not seen or spoken with his family for several years now.
"I have not spoken with them since 2003. I only get informed of their whereabouts and activities in the news," he said.
He stressed he is glad that his family is fighting the government's effort to have them extradited to face trial on the forfeiture lawsuits and for plunder, which could mean detention for the duration of the cout proceedings.
This is because he feels certain that his wife, Clarita and children, Ian Carl, Juan Paulo and Timothy Mark will not get fair treatment, particularly in the local press.
"The prosecution made sweeping charges but it has failed to present evidence in court. They said I have started plundering since 1993 and used my sons as conduits. How is that possible, my eldest son was only 10 years old at that time? But nobody raised questions like this in the media. We were simply condemned," he lamented.
He pointed out that his wife and children did not go into hiding but have been using their own names in public.
"Ang dami diyan, nag-iba ng pangalan. My sons were there, living out in the open. They did not even use assumed names," Garcia said.
