MANILA, Philippines - The camp of former President Gloria Macapagal on Friday filed a formal written motion before the Sandiganbayan to defer the arraignment of Mrs. Arroyo and 2 co-accused for a plunder case.
The motion accused the Office of the Ombudsman of committing "grave abuse of discretion" in finding probable cause in the plunder case against Mrs. Arroyo.
It said the former President plans to file a petition for certiorari before the Supreme Court to nullify and seta side the resolutions of the Ombudsman finding probable cause in the case.
The lawyers argued they need more time to prepare the petition for certiorari before the SC, hence the need to defer the arraignment on Monday, October 15.
The Arroyo camp also requested the anti-graft for subpoena ad testificandum and duces tecum to the director of the Veterans Memorial Medical Center, Dr. Nona Legaspi.
The lawyers said they want Legaspi to testify and present Mrs. Arroyo's medical records before the Sandiganbayan when the court hears the former President's motion for hospital on October 18.
The Sandiganbayan earlier asked both prosecution and defense lawyers to present Mrs. Arroyo's physicians to testify on the former President's medical condition.
