Miriam raises legal questions over Padaca appointment

MANILA, Philippines - Sen. Miriam Defensor-Santiago on Monday said there are serious legal problems with the appointment of former Isabela Governor Grace Padaca as Comelec commissioner.

She cited the constitutional provision that a person who ran in the immediately preceding election must not be appointed as commissioner.

Padaca's supporters have said the October 2010 barangay elections, not the May 2010 polls where Padaca ran, was the immediately preceding election.

While this may be true, Santiago said Padaca and her supporters must remember the purpose of the law.

"What was the purpose? To prevent a partisan person from participating in the process of regulation and administration of election laws," she said.

Santiago said she will raise this issue during Padaca's confirmation hearing at the Commission on Appointments.
