MANILA - The Sandiganbayan First Division junked a motion seeking to transfer Senator Ramon “Bong” Revilla Jr. and Atty. Richard Cambe to Camp Bagong Diwa in Bicutan, Taguig or to any regular jail.
"The prosecution failed to advance compelling and reasonable grounds to justify the transfer of accused Revilla and Cambe from the PNP Custodial Center to a [Bureau of Jail Management and Penology] controlled jail," a 12-page resolution read.
The prosecution, in its motion submitted in July, argued that Revilla and Cambe should be placed in a regular jail following their arrest on charges of plunder and graft from their alleged involvement in the pork barrel scam.
The prosecution said their continued detention in the PNP Custodial Center affords them special treatment, and is a violation of the rights of Senator Juan Ponce Enrile's chief of staff and lawyer Gigi Reyes, who is also accused of plunder and is now being held in Camp Bagong Diwa.
"The Court solicitously agrees that it is the fact of detention and not the place of detention that is important," the court said.
"Like Atty. Reyes, and other detention prisoners, accused Revilla and Cambe are also deprived of their liberty as a consequence of the grave offense of plunder," the court added.
Revilla’s lawyer, Joel Bodegon, lauded the decision of the anti-graft court, saying that it will boost the morale of the detained senator.
He said Revilla is also wary of the security concerns if he is transferred to a regular BJMP facility.
